RHOBH’s Erika Jayne has been dismissed from the fraud and embezzlement case against Tom Girardi, according to new reports.
According to a report from Us Weekly, new court documents were filed in Illinois today (January 29) and show that Erika is being let go from the case against her estranged husband.
“Pursuant to stipulation, plaintiff’s claims against defendants EJ Global LLC and Erika Girardi are dismissed without prejudice and without costs,” according to the Saturday, January 29, court docs filed in the Northern District of Illinois, which the magazine obtained.
The news comes as The Real Housewives of Beverly Hills are vacationing in Aspen, Colorado together for Season 12, so the case against Erika being dismissed is sure to be brought up during filming.
Attorney Ronald Richards, who was once involved in the case from California, has stated that the case was dismissed without prejudice (which means it can be refiled) and also mentioned that the plan may be for the case to be filed in California.

UPDATED Saturday, January 29 @ 3pm EST: According to a new report from Reuters, the law firm handling the case does plan on re-filing against Erika Jayne in California. The re-filing news shouldn’t come as a surprise, either, as the revelation was disclosed in previous court documents, according to the news outlet.
Sunday, January 30 @ 8am EST: The attorney handling Erika’s case, Jay Endelson, has revealed that they do plan on re-filing in California.
