Kroy Biermann still wants to divorce Kim Zolciak despite engaging in sexual relations with his estranged wife, his lawyer states in new court documents.
“The fact that he engaged in sexual relations with Respondent does not indicate a desire to reconcile,” a motion in the case obtained by Radar Online reads, adding that Kroy’s team says he “remains steadfast in his desire to divorce” the former Real Housewives of Atlanta star.
Earlier this week, Kim filed a request with the court to dismiss Kroy’s divorce petition alleging that the two were still having sex.
Now, Kroy is accusing Kim’s recent motion as just another “delay tactic” as he looks to exit the relationship amid growing financial hurdles.
Just recently, Kroy made it clear that he wants to sell their $3 million Atlanta-area home to help pay off their bills but allegedly, Kim has no interest in doing so.
“[Kim] made it clear that she does not intend to leave the residence, despite the fact the home is currently in pre-foreclosure,” read the court documents. “She has stated that she prefers to file for bankruptcy; a move that will ensure that the parties and their children will remain under the same roof for a significant period of time.”
He continued, “Without the receipt of equity from the sale of the marital residence, the parties cannot afford to move out of the residence and into new residences.”
As a result, Kroy is requesting the court dismiss Kim’s motion and that an emergency hearing about the sale of the home is scheduled.
Unpaid taxes and huge financial issues
As previously reported on TVDeets.com, Kroy Biermann and Kim Zolciak are set to divorce amid huge financial issues, including the fact that they allegedly owe over $1 million to the IRS in unpaid taxes.
The two have since traded insults in court, with Kroy recently requesting the court look into Kim’s “abusive” behaviour.
Page Six reports that Kroy Biermann’s legal team filed new documents in an Atlanta-area courtroom on Thursday, September 14 requesting the court look into Kim Zolciak’s behavior. In the docs, Biermann claims that while he “attempts to shield the children from the negative fall-out” of their contentious split, Zolciak continues to use “abusive, profane, and threat-laden language” at him with “little concern if the children are present.”

According to the documents, Kroy believes Kim was using their divorce to get back on The Real Housewives of Atlanta. He claims he has “been picking up all the slack, cleaning the home, picking up after the children, and preparing their meals” since the couple had to “fire the nannies, chefs and housekeepers” due to their ongoing financial issues.
Kroy Biermann and Kim Zolciak both filed for divorce from each other back in March before calling it off and reconciling. Kroy then filed for divorce for the second time in August and is requesting sole legal and physical custody of their four minor children in addition to the court-appointed guardian.
Kim, for her part, will not be returning to RHOA but has instead signed on for the next season of MTV’s The Surreal Life.
